Questions or concerns? Reading this Privacy Notice will help you understand your privacy rights and choices. We are responsible for making decisions about how your personal information is processed. If you do not agree with our policies and practices, please do not use our Services. If you still have any questions or concerns, please contact us at privacy@oxvegas.app.
This summary provides key points from our Privacy Notice, but you can find out more details about any of these topics by using our table of contents below to find the section you are looking for.
What personal information do we process? When you visit, use, or navigate our Services, we may process personal information depending on how you interact with us and the Services, the choices you make, and the products and features you use, including your name, email address, phone number, username, and — with your consent — your device's precise location. In our mobile app we also record first-party usage analytics about how the app is used, which you can turn off in the app's settings. Learn more in Section 1.
Do we process any sensitive personal information? Some information may be considered "special" or "sensitive" in certain jurisdictions — for example, racial or ethnic origin, sexual orientation, and religious beliefs. We do not process those categories of sensitive information. We do process precise geolocation, which some state laws classify as sensitive; we do so only with your consent, as described in Section 1.
Do we collect any information from third parties? We do not purchase or collect information about you from third-party data brokers or marketing partners. We do receive limited profile information (such as your name, email, and profile picture) from Google or Apple if you choose to sign in using one of those providers. Learn more in Section 4.
How do we process your information? We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent. We process your information only when we have a valid legal reason to do so. Learn more in Section 2.
In what situations and with which parties do we share personal information? We may share information in specific situations and with specific third parties. Learn more in Section 3.
How do we keep your information safe? We have adequate organizational and technical processes and procedures in place to protect your personal information. However, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Learn more in Section 6.
What are your rights? Depending on where you are located geographically, the applicable privacy law may mean you have certain rights regarding your personal information. Learn more in Section 8.
How do you exercise your rights? The easiest way to exercise your rights is by emailing us at privacy@oxvegas.app. We will consider and act upon any request in accordance with applicable data protection laws.
In Short: We collect personal information that you provide to us.
We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.
Personal Information Provided by You. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:
SMS and Notifications. If you provide a phone number, we may send you SMS text messages, such as venue activity alerts, rewards notifications, and account notices. We only send you SMS messages if you separately opt in by checking the SMS consent box presented at signup — providing a phone number alone does not enroll you in text messages. Consent is not a condition of using the Services. Message and data rates may apply, and message frequency varies. Reply STOP to any message to unsubscribe, or HELP for assistance.
Sensitive Information. We do not process sensitive information such as racial or ethnic origin, sexual orientation, or religious beliefs. We do process precise geolocation, described below, which certain state privacy laws classify as sensitive personal information; we collect it only with your affirmative consent.
Social Media Login Data. We may provide you with the option to register with us using your existing social media account details, such as your Google or Apple account. If you choose to register this way, we will collect certain profile information about you from that provider, as described in Section 4 below.
Application Data. If you use our application(s), we also may collect the following information if you choose to grant us access or permission:
This information is primarily needed to maintain the security and operation of our application(s), for troubleshooting, and for our internal analytics and reporting purposes.
All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.
In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.
We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.
The information we collect includes:
In Short: Our website shows public bar information and does not need an account. When you open one of our tracked links, we count the click without recording who you are.
Website. The oxvegas.app home page loads bar names and the latest line reports (and a typical-night estimate) that members have submitted, using read-only requests to our database. It does not ask you to sign in, and it does not use advertising or cross-site tracking tools. As with any website, our hosting and database providers receive your IP address and browser details when your browser makes these requests, as described under “Information automatically collected” above.
Tracked links. Links of the form oxvegas.app/go/… (for example, the button on our home page, a QR code on a poster, or a link a friend shares) record one count for the link’s name, the day, and a coarse device type (iPhone, iPad, Android, computer, or other), and then send you to the App Store. We do not record your IP address, your full browser string, the page you came from, or cookies for this count. App Store Connect separately gives us aggregate App Store page-view and download counts for these campaigns, under Apple’s privacy policy.
Referral links. If you open a referral link from a member, we record that the link was opened, with the referral code and your browser’s user-agent text (shortened), so the member can be credited if you join.
In Short: Our mobile app records which features you use so we can understand how it is used and fix problems. This analytics is first-party, is not sold, is not shared for advertising, and is not shared with anyone except as described in Section 3; it is deleted after 365 days, and you can turn it off in the app's settings.
What we record. When analytics is on, our mobile app records events about how you use it, such as:
Identifiers. Analytics events are associated with a random install identifier that the app generates when it is installed. It is not your device's advertising identifier, and you can reset it at any time. When you are signed in, our server also associates events with your account ID. Because of this, analytics recorded while you are signed in is linked to your account.
What we do not put in analytics. We do not include your precise location, your contact information (such as your name, email address, or phone number), any free text you type, or your photos in analytics events.
Why we use it. We use analytics to understand how the app is used, to find and fix problems with onboarding and sign-in, to measure whether features are working, and for security and fraud prevention. Where applicable law requires a legal basis for this processing, we rely on our legitimate interests in identifying usage trends so we can improve the Services and in protecting our Services, which are among the purposes listed in Section 2. Analytics is on by default; you can object to it and turn it off at any time, as described below.
First-party only. Analytics events are sent only to our own database, hosted by our database provider (Supabase), which processes them on our behalf as described in Section 3. We do not use any third-party analytics or advertising software development kit (SDK), we do not use analytics for advertising, we do not track you across other companies' apps or websites. Analytics data is not sold, and is not shared for advertising or otherwise, except as described in Section 3.
How long we keep it. Raw analytics events are deleted after 365 days. We may keep aggregate statistics (for example, the number of check-ins per week) that do not include any identifier and cannot reasonably be linked to you.
Your controls. In the app, go to Settings > Privacy & Security, where you can:
Deleting your account also deletes the analytics linked to it. These deletions are sent from the app to our servers, so if your device is offline at the time, a deletion request may not reach us; you can always ask us to delete your analytics data, or confirm that it has been deleted, by emailing privacy@oxvegas.app.
In Short: If you turn on live heat, the app uses your location while the app is open to work out which bar you are near, so we can show how busy each bar is. We keep only the name of the bar and a time, for 45 minutes. We do not store your coordinates. It is off unless you opt in, and you can turn it off and delete your data at any time.
Opt-in only. Live heat is off by default. It starts only after you choose “Turn on live heat” in the app, either in the one-time prompt or in Settings, and only if you have allowed location access (“While Using the App”) in iOS. If you do not opt in, none of this applies to you and you will not see the live heat map.
What we use. Each time you open the app, if you have opted in, the app sends your device’s precise location to our server once, in a single request. The server uses it only to find the nearest participating bar within about 1,000 feet. The latitude and longitude are not stored, logged, or kept in analytics. The app does not collect your location in the background. Live heat may be switched on for members gradually: if you opt in before the map is available to you, the app already sends your location in this way each time you open it (so the map is ready when it launches), even though you cannot see the map yet. The app tells you this when you opt in.
What we keep. We keep one record per member: your account ID, the name of the matched bar, and the time. A new open of the app replaces it. If you move away from every bar, the record is removed. Records older than 45 minutes are not counted and are deleted.
What others see. Members who have also opted in see only a general level for each bar (“Quiet”, “Busy”, or “Packed”), and only when at least five members are counted there. No member is identified and no counts are shown to members. Our administrators can see numbers of members per bar to run and tune the feature.
Why we use it. To provide the live heat feature you asked for, based on your consent.
Your controls. To opt out, go to Settings in the app and turn off Live heat. Doing so stops the app sending your location for live heat at once, and deletes your live heat record and removes your opt-in (if your device is offline, the app retries the deletion the next time it can reach us). You can also turn off location access for oxvegas in iOS Settings, and deleting your account deletes your live heat record. If you cannot reach these controls, email privacy@oxvegas.app. Opting in or out is also counted as a usage analytics event (for example, that you turned it on from Settings), without any location.
In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.
We process your personal information for a variety of reasons, depending on how you interact with our Services, including:
In Short: We may share information in specific situations described in this section and/or with the following third parties.
We may need to share your personal information in the following situations:
In Short: If you choose to register or log in to our Services using a social media account, we may have access to certain information about you.
Our Services offer you the ability to register and log in using your third-party account details, such as your Google or Apple account. Where you choose to do this, we will receive certain profile information about you from that provider. The profile information we receive may vary depending on the provider concerned, but will often include your name, email address, and profile picture, as well as other information you choose to make public on that platform.
We will use the information we receive only for the purposes that are described in this Privacy Notice or that are otherwise made clear to you on the relevant Services. Please note that we do not control, and are not responsible for, other uses of your personal information by your third-party sign-in provider. We recommend that you review their privacy notice to understand how they collect, use, and share your personal information, and how you can set your privacy preferences on their sites and apps.
In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.
We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice will require us keeping your personal information for longer than the period of time in which users have an account with us. As a general guide:
When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.
In Short: We aim to protect your personal information through a system of organizational and technical security measures.
We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.
Security incident notification. If we discover a security breach affecting your personal information, we will notify affected users by email or in-app notice without unreasonable delay, as required by applicable law.
In Short: We do not knowingly collect data from or market to children under 18 years of age.
We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent's use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from children under age 18, please contact us at privacy@oxvegas.app.
Our mobile app's in-app usage analytics (see Section 1) can begin before you create an account. If we learn that an account or app install belongs to someone under 18, we will also delete the analytics data associated with that account or install.
In Short: You may review, change, or terminate your account at any time, depending on your country, province, or state of residence.
Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us using the contact details provided in Section 12 below.
However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.
If you would at any time like to review or change the information in your account or terminate your account, you can:
Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.
If you have questions or comments about your privacy rights, you may email us at privacy@oxvegas.app.
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.
California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.
Separately from DNT, our mobile app respects its own analytics setting: if you turn off Share usage analytics in Settings > Privacy & Security, the app stops recording in-app usage analytics, as described in Section 1. We do not engage in cross-app or cross-site tracking.
In Short: If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, you may have the right to request access to and receive details about the personal information we maintain about you and how we have processed it, correct inaccuracies, get a copy of, or delete your personal information. You may also have the right to withdraw your consent to our processing of your personal information. These rights may be limited in some circumstances by applicable law. More information is provided below.
